The Law on the Protection of Consumer Rights provides for a refund for a service if it was provided poorly or not provided at all, including if the service deadline was violated. The procedure for refunding funds can be through a claim or through the court.
Claim procedure for refund of money for services
If the service was provided poorly, you must send a claim to the address of the company that provided the service.It should indicate all the circumstances of the incident:
- time and place of service provision
- the essence of the claim (statement of details of the unsatisfactory quality of service, periods or the violated deadline)
- applicant’s details and full name of the contractor (company, entrepreneur).
The claim must be accompanied by copies of documents confirming payment for the service and, if available, a copy of the contract (receipt). Only copies of documents are attached to the claim; the originals must always be in your possession.
The period for considering a claim is regulated by law and depends on the requirement formulated in the claim. The period for eliminating deficiencies by the performer (contractor) is determined in the article “On the Protection of Consumer Rights”. If the company that provided the poor-quality service does not intend to settle the dispute through a claim procedure, the consumer should recover funds through the courts.
